  MAPPOINT DOWNLOADS: License Agreement  
Terms and Conditions
CACI Marketing Systems ("CACI") provides its Consumer Expenditure Data (Food Service, Apparel & Accessories, Automotive, Drug, Home Furnishings, and/or Leisure & Entertainment, hereinafter referred to as "DATA") to the END-USER via the MP2K Magazine website subject to the terms and conditions set forth below:
  1. Limitation of Liability
    1. The DATA is provided by CACI on an "as is" basis with no warranty whatsoever. The DATA provided by CACI to the MP2K Magazine website is intended as a sample only to illustrate the type of DATA offered by CACI.
    2. Limitation of Liability
      EXCEPT AS SET FORTH ABOVE, CACI MAKES NO REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, AS TO MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR ANY PARTICULAR PURPOSE OR OTHERWISE WITH RESPECT TO THE DATA RENDERED TO THE END-USER PURSUANT TO THIS AGREEMENT VIA THE DIRECTIONS MAGAZINE WEBSITE. NOR SHALL CACI BE LIABLE FOR ANY DIRECT, SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES EVEN IF IT HAS BEEN OR IS HEREAFTER ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND WHETHER OR NOT DUE TO CACI's NEGLIGENCE.
  2. Copyright
    All copies of any media containing the DATA prepared by the END-USER shall have the following notice affixed thereto in such a manner and location as to give reasonable notice of its contents: "Copyright CACI."
  3. Restrictions on END-USER's Use
    1. END-USER is granted permission to download the Data only for internal purposes of END-USER's organization, including any and all subsidiaries and third party customers to which such information is provided in the ordinary course of business.
    2. The DATA is provided for sample purposes only and is not intended for resale.
  4. Governing Law
    This agreement shall be governed by the laws of the Commonwealth of Virginia. Should any provision of this agreement be held to be contrary to law, the other provisions shall remain in full force and effect.
  5. Entire Agreement
    This agreement constitutes the entire understanding between CACI and the END-USER concerning the subject matter hereof as described in the introduction to these terms and conditions.
